Hi- thank you for reaching out to us. Some companies like to use a business terms agreement in anticipation of a lease. There are some legitimate reasons for using a business terms agreement - namely, that the tower company doesn't want to spend a lot of time or money on due diligence only to have the landowner come back and significantly increase their lease terms. It helps the tower company know that the landowner is serious.
On the other side of the coin though- it also is written to discourage sharing the terms with a cell tower lease consultant or expert like Steel in the Air. It also prevents the landowner from sharing what they are getting with potential other candidates nearby. Some tower companies (not saying whether Tillman Infrastructure does this or not) will tie up more than one piece of property in an area and then choose the best one based upon what terms they agreed to in the business terms agreement.
Typically it is best for us to get involved before the term sheet is signed. The site ac agent can get frustrated when a landowner renegotiates after signing a term sheet. We do help people at this early stage- but we don't always recommend that you hire us this early. We will review the location at no cost and tell you whether we think there is value to be gained by using our services. If we think that Tillman could just as easily use another property, we will tell you so. THen you can sign the term sheet and proceed. However, if we think we can help (or if we can't tell without more research) we will provide a quote for services.
