The FAA dictates when to have lights on towers and/or what paint patterns or light patterns a structure owner has to have. FCC rules have the teeth that force the structure owner to comply with the FAA marking rules. The reason for tower lighting or painting is to make pilots aware of the structure, therefore if the lights on your tower are out, not functioning properly or if your tower paint is faded, you have to call the FAA and file a NOTAM (Notice to Airmen) so pilots will be alerted, when they file their flight plan, that there is a structure in their flight path that may not be visible.
